A state court has denied bids by Kalshi and Polymarket to suspend enforcement actions against them, allowing gambling-related cases in Nevada and Washington to proceed. The ruling keeps regulatory pressure firmly on the two leading prediction market platforms as states push to classify event contracts as illegal gambling.

What the Court’s Denial Means for Kalshi and Polymarket

Both Kalshi and Polymarket sought to halt state-level enforcement actions while broader legal disputes over prediction market regulation play out. The courts rejected those requests, meaning enforcement proceedings in Nevada and Washington will continue without pause.

A denial of a bid to suspend enforcement is a procedural ruling, but a consequential one. It means the platforms cannot operate free from state scrutiny while waiting for a final legal resolution. Enforcement remains active, and both companies face ongoing compliance obligations in those jurisdictions.

Washington’s case is particularly aggressive. The state’s attorney general sued Kalshi for operating an illegal gambling platform, arguing that its event contracts violate state gambling laws. Polymarket operates on blockchain infrastructure and has become one of the most recognized crypto-adjacent platforms in the prediction market space. The ruling’s impact extends beyond traditional gambling law into the digital asset ecosystem, where prediction markets have attracted significant trader interest.

For users and traders on these platforms, the immediate effect is uncertainty. Active enforcement means potential restrictions on market access, deposit mechanisms, or contract availability in affected states. This follows a U.S. appeals court also recently rejecting a stay request from both platforms, compounding the legal setbacks.

Crypto investors watching the prediction market sector should note the distinction between the court’s procedural ruling and any final determination on legality. The denial of a stay does not mean the platforms have been found guilty of operating illegal gambling operations. It simply means enforcement will not be paused pending further litigation.

The Regulatory Battle Over Prediction Markets

The cases sit at the center of a jurisdictional fight between state gambling regulators and federal agencies. The CFTC has historically overseen event contracts through its authority over derivatives markets, and has issued its own guidance on prediction market oversight. The question of whether federal preemption shields platforms from state gambling laws remains unresolved.

Washington and Nevada represent two different regulatory philosophies, one rooted in consumer protection and the other in gaming control, but both have reached the same conclusion: prediction markets require state-level oversight regardless of federal classification.

The enforcement wave is part of a broader pattern of regulators tightening oversight across the crypto sector. While institutional players like Harvard reassess their digital asset exposure, and platforms face consequences for security lapses as seen in the recent Verus protocol hack recovery, prediction market operators are navigating an increasingly complex compliance landscape.

The next phase to watch is whether Kalshi or Polymarket escalate their legal challenges to federal courts, seeking a definitive ruling on preemption. Until then, state enforcement actions will continue to shape how and where these platforms can operate.
