The Senate cloture vote is scheduled for September 15. It requires 60 votes to advance. All 53 Senate Republicans have committed to voting yes, meaning 7 Democrats must cross the aisle. The rumor suggests those votes may now be secured.

The Ethics Dispute at the Center

The ethics provisions have been the main point of contention between the two parties. Senator Cynthia Lummis’s Subcommittee on Digital Assets published a detailed breakdown of the updated bill. The provisions prohibit any covered individual, including the President, Vice President, Members of Congress, and federal judges, from issuing or sponsoring a digital asset in exchange for consideration.

Violations carry real consequences. Any digital asset intermediary that knowingly lists a violating token faces a civil penalty of up to $250,000 per violation, per day. Covered individuals who violate the ban must disgorge all profits and pay a penalty equal to 10% of the consideration received or $500,000. Despite these amendments, many Democrats remain unconvinced.

Senator Lummis has made the stakes clear publicly. She warned that failure to pass the bill this Congress pushes the next realistic opportunity for crypto market structure legislation to 2030. The House adds further pressure. Republican leadership canceled the final two weeks of its September session.

Members leave Washington by September 17, leaving only a two-day window after the Senate vote. If the Senate passes an amended version, the House must approve the changes before it reaches the President’s desk.
